If you go to my website, there is a link at the bottom, "How To Answer A SOL lawsuit".

The Florida page on my website has the Florida statutes that determine that a credit card account is considered an "open-end" account, and NOT a contract in writing.

All you need is to make copies of the TILA statutes, (from the "how to") and the Florida Statutes,plus requiring the plaintif PROVE when the account became in default before the chargeoff. (that is the legal time for the start of ANY SOL in Florida)

Make SURE that any documents you produce are ENTERED into your case file. (make an extra copy to give to the plaintif, and an extra one for yourself)

If you put the Court's copies in a blue legal cover, with a label on the front with your case information,it will be MUCH more professional looking, and the judge will be less likely to ignore you.
