Striking back at JBC, Absolute, US Financial Recoveries, AND Byck!!

Wow, what a day here in NC--

I filed suit against one Harrison Ross Byck and two of his staff lackeys a couple months ago. The morons declined my $100 (one hundred dollars, sheesh) presuit offer, and then didn't answer the complaint, so now I have an entry of default and a court date 09 Jan to determine damages. For some reason I had a conscience attack and called with a thousand-dollar offer today, and got Byck himself. He had less of a bad attitude than before but still declined.

Clients have been coming to me more often, and I have started proceedings against Absolute Collection Service, my hometown medical bill bullies. Today they didn't want to talk about the case until I had a written release from my client. Well, they didn't have any problem "discussing" her private affairs with somebody they thought had money to pay! So I sent a "call and talk settlement" fax, probably they will ignore it and find out why they shouldn't.

Then there's US Financial Recoveries, who on behalf of the OC collected about $900 from another client and then decided to keep it themselves. They denied receiving anything from my guy, never mind the cancelled checks with "US Financial Recoveries Inc. Client Trust Account" endorsement. When I called USFR they accused the OC of lying and said "we're going to sue them for defamation." Oh dear Lord, I about lost bladder control laughing at that. Defaming USFR is impossible--their reputation simply can't be made any worse than it already is! Their law firm seems, however, to have some sense and said they'll try to make us happy. They had better.

Finally, I met this morning a new client who's been getting calls from your friends and mine, JBC and Associates, which is just another set of prostituted law licenses. Big surprise--they're dinging him for a 1993(!?!) alleged bad check that he has no recollection of writing, that shows up on no credit report, that the alleged retailer never heard of, for a total amount of $76.20 plus $25.00 statutory bad check fee. Someone needs to explain to these legal eagles the concept of SOL--they must have been asleep that day in Civil Procedure class--and of cost-effectiveness. They considered this worth four nasty calls and a letter, and I just found out, two more hang-up calls today. I called them twice and faxed them twice, and finally got someone to talk to me. I suggested a $200 settlement, which is waaay below what they'll pay to defend it, much less what they'll pay when they lose. They said, "well how is he going to take care of this?" Is this what they call willful cluelessness? I said, "no, YOU are going to pay US so we won't sue you for fraud and FDCPA." They bade me farewell and hung up. Whatever. All this over $101.20. Pray givest thou unto me a break. My client will show up in court with that amount in cash in case they can provide proof of the debt. And this good fellow contacted me here.
