Finding a lawyer you can work with is a matter of calling a few and getting free consultations. Most of them offer these. You want someone who's main business is doing bankruptcies, not someone who only does them infrequently. If you can find one that used to be a Trustee, they're even better to get - they know both sides of the table. If they try to SELL you on a CH 13 right off the bat, walk away - they're after the bigger fee. Take good documentation of your debts and your income and expenses with you, this will help a lot. If the lawyer is good and not out for a bigger CH 13 fee, he/she will go over things with you in some detail. You might also want to look for one that will accept payments for their fee if you need to.

As for the lawsuit you've been served with, take it with you, they lawyer will need to know that. Go ahead and Answer the complaint with a general denial (see WhyChat's site on how to do the Answer). If you can't file before your court date, wait a couple of weeks, then call the court and ask for a postponement.. you're entitled to one. That should push it out at least another 30 days if you need the time to get filed.
