A legal foreclosure creates good title, a "voluntary" deed back to the lender is next to worthless as you have no "clear" title to deed to them.

IF, you or they had another buyer who was willing to refinance immediately, and IF you had enough equity left to take care of all the extra costs, or a buyer who was ready willing and able to pay the extra closing costs, THEN a "voluntary" deed back to the lender could work, but otherwise they would be sitting with an unmarketable property with a flawed title.
