It may be true that Mo. is difficult for an unprepared person to use the 5 year SOL defense,however, MANY on this forum have ued it sucessfully, IF they followed the instructions and provided copies to the Court of all supporting material.

In 1 case,they lost in lower Court and requested an administrative law hearing,this is NOT an "appeal" so it does not show up on any Appeals Court decisions. It is only for points of LAW.

They won the ruling and the lower Court had to rehear them and they won their defense.

If you send the SOL letter it will let the CA know that you wll fight them on any lawsuit, it will also allow you to collect damages IF they went ahead and filed, as they would have been legally infomed of the SOL and therefore would be in violation of the FDCPA if they sued.
