The filing date is the date used.
If you make copies of the Florida statutes on the Florida page of my website, and make copies of the affirmative answer from the How To Answer A Time Barred Lawsuit on my wesite, (including the copy of the TILA) and make sure this is entered into your case file as evidence of the 4 year SOL, the Judge will either rule in your favor on the SOL defense, or if he does not, you can request review of the case by an administrative law Judge.
