Drew, you have a good memory.

No, I decided NOT to file a counter suit. I chose NOT to do so because at this point, my intentions are to sue them in the Supreme Court for the filing of 2 bad faith cases so far. (They did this once before, too but they dismissed before the case ever got this far).

I plan on suing them in the Supreme Court for filing 2 bad faith cases. In addition, I will be suing them for everything else they have done: falsifying documents, re-aging my account, FDCPA violations, and a slew of various other infractions they have managed to incur as a result of these 2 cases. However, at this point, not counter suing has worked, AND I could now use advice on if they might be a more strategic move at this point in time. This is the second bad faith case they have filed, and at this point, they have incriminated themselves even further with their own information.

So, to answer you question, I am not quite sure if filing a motion to dismiss is the most strategic advantage, or if waiting to have my case presented before the judge is better based on my intentions to sue them in higher court. The higher court is more important than small claims where it can go on public record for everyone to see and where they can receive more disciplinary action. They really take advantage of people, and it is time it stops. At this point, with 2 cases and lots of evidence, they have dug themselves in deep. I would much rather be heard before a higher court than to file a simple counter suit. Get my drift?

But what do I know? This is why I am asking. Everything I know I have learned from these boards. I could be dead wrong. This is why I am asking for advice as to how to proceed.
