I have had successful levies on 401k funds, because banks, some employers, and individuals just don't know the law. As you have now been advised that they are indeed exempt, don't let anyone levy on your qualified retirement funds. Just because it is exempt, does not mean that someone could not add it to the General Execution and attempt to levy the funds. Many Court Clerks don't know and sign the Execution and send it right down to the Sheriff to be levied.
