The attorney's do not have a good lawsuit yet, as you have not been served. I believe you said you lived in a different state, or other than the one they attempted service in. When your court day is scheduled, the attorney will show up and the Judge will inform him that they don't have service on you. They may or may not attempt an alias summons or different type of service. The attorney may also shelf this for a better day. So...until you are served, they don't have a Judgment and can't get anything from you. If the attorney doesn't know where you live, at the present time, don't correspond with them and give them your current address, because they probably won't work with you and are only interested in obtaining a Judgment so they can then go after your assets.
