I have a judgement against me and the plaintiff tried to have my wages garnished. I went to the court and applied for a motion for installment payments which I was granted. I have to send $200 a month to the "attorney". (I am declaring chapter 7 in January-just buying myself some time) I have made 2 payments. This "attorney" also sent me a summons for a different credit card. Have not received anything about a judgement/garnishment for this one. I just received two different statements from the attorney. My $200 payment is being applied as follows $100 to first judgement ( I knew about this one) and $100 to the other card. I never agreed to pay anything for the second debt. Is this legal? I think the whole $200 should be applied to the first debt as this is what we and the court agreed upon. (Also-FYI I received these statements for my December payment-never received these statements for my November payment wonder what happened to that $200 bucks) Any advice would be appreciated! (Again-I'm filing Chpt 7 in 3 weeks but I just wonder if this is a violation)
