I recently found this web site and have been reading for hours researching my options. I've read a lot on here about W&A, sems their pretty busy lately. Here is my situation. $13300 in CC debt. Probably only $10000 of that amount is what I used. Only been late for about 1.5 years, and I live in Indiana. I have a house with roughly $20k in equity by the appraisal. I had been talking with MBNA for a settlement when they turned it over to W&A because it went 6 mos late. I had been in the hardship program before that. Which was a total waste of time, and hence why I quit paying altogether. From everything I've read here, is that I shouldn't bother with validating this debt and a C&D because it's not beyond the SOL. I should however not agree to any arbitration hearing. But beyond that I don't know what else to do. I know I shouldn't pay W&A any money but I'm not sure if MBNA charged off this account or not. I'm also thinking about making an appointment with a BK attorney to explore that avenue. Any help or guidance would be appreciated.
