Here's something that might be able to be used. Motion to Dismiss based on 15 USC 1692i 811(b). This came up before on other forums that I've been a member of. Like I said there is nothing in the FDCPA to allow debt collectors to sue. There job is to try and collect money for a creditor not sue on behalf of a creditor if they are acting as a debt collector.
