If you had your home deeded to joint ownership with your new husband, you are better off filing BK and getting everything off your mind. If any of these debts were joint with your ex, HE will be stuck with them ENTIRELY if you file.

A BK lawyer will usualy not charge you for an initial consultation, and this will enable you to answer the lawsuit wih a "stay" from your BK lawyer.

If, however, your home is entirely in your name, and you have more than $10,000 equity, you will need to figure out with the BK lawyer how to answer this lawsuit and avoid a judgment.

Your situation is WAY too involved for you to try to do this on your own.

I am assuming the account you are being sued on is the same account you used for a purchase or cash withdrawal in 11/2002. If it is ANY OTHER of your accounts, you may be beyond the 3 year NC SOL.
