If Citi is a "debt collector" here..they might just be under these facts. If they are a "branch" of Sears as you say that they say, then it would make them more of a debt collector as they are obviously (regularly) engaged in collecting debts for another (Sears). "Debt collector" under FDCPA can turn on the use of a 3rd party name (Citi) to collect a Sears account. Citi is also engaged in a lot of other business practices besides debt collection, and that factor cuts in their favor and against holding them as a "debt collector" under FDCPA.

Someone else mentioned below that Citi is a collector under the FDCPA. I can't link the articles referenced, but I would look into that question and examine the notices that you received and reflect on the method of collection.

Did Citi provide any 1692g validation notice?
