i'm the one with the judgment from a foreclosure back in 97, the equity loan company (huntington) obtained the judgment in 97 but never collected.. i never even was served... i went to the hearing on 11/20 with an attorney stating they only had 2yrs to collect according to the ohio revised code and also requested to vacate the judgment because of improper service... the judge granted them a continuance, their argument was that a judgment in ohio can be renewed every 5yrs which is true according to ohio revised code also, however the code i am using has a property attached to a loan provision which gives them 2yrs to collect on the deficiency... when i was "served" it was by regular mail according to them not certified and they state that this is good enough... i go back to court on the 23rd..... can i lose? even though i have an ohio revised code behind me... any suggestions.. i know i have asked for a lot from you and the board regarding this and i really really appreciate all the help...
