Did your Uncle sign anything from the Postman? Go to the Court house again and ask to look at your file. Look for the servicing document and see what the servers return says. Does it say whether he was served or not? Then read the transcript in your file and see what events transpired. After you have done this, get back to me.

Not being served, and the fact that the SOL was not brought up on your Uncles court date, is not enough to get your Judgment vacated, in my opinion. You must claim the SOL when you are being tried, not after a Judgment is rendered. The Judge will make the final decision. I just don't think he will rule in your favor.
