I posted 12-13. In NC also, Citibank acct with complaint attached to summons. Spoke with two BK attorneys, both said cannot use usury as a defense in NC any longer. Stated that I did not have a legal defense to not paying...have a good "reason" that I did not pay, but not a defense. They both want to talk BK (one also recommends a "good" divorce lawyer) Because of paying off majority of my debt Jan. of this year with divorce settlement, I don't have much other than this acct to file BK. Family is wanting me to contact creditor/attorney and try to settle the acct before court date is set, etc. Is it possible to settle after receiving a summons??? Again, thanks for all input....it is greatly appreciated!
