I have a TU report from 2002 showing the account being held by Citi and charged off 10/1996. I also have my last billing of August 1996, and a collection letter from October of 1996.

My wife and I have both opted out FOREVER, but about two weeks before the application.

Please (if you can stand it) explain why this would fall under the new rules rather than the old?

MERELY MY LAYMENS UNDERSTANDING:

If it falls under the new, then they have 6 months from the date of charge off, collection, deliquency etc to report... If it falls under the old it's at the charge off date.

At this point I'm looking for direction of accepting the 40% settlement offer to move the mortgage forward(btw the mortgage company hasn't asked, it popped AFTER the first pull) or waiting the remaing time of the online dispute ~3 weeks?

I'm also sending a friendly followup correspondance to Experian w/ copies of the above statement and letter to help them see what I see.

I'm a grownup and realize that I'm asking for help in an open forum, I absolutely don't hold anyone responsible for their opinion here, if I take advice and it bites me.
