I believe that for the FDCPA violations, you file in Federal Court. Those judges are more on top of the law and understand the violations better.

If you file on the federal violations in small claims, you will probably be dismissed for wrong venue.

You might want to get a consumer lawyer to represent you..the original credit card agreement provides for the winning party to have their legal fees paid, so you will get your money and the lawyer will be paid by the other side. Besides, they know all the angles and might get you more than you ever expected.
