I'd like more info because I seem to have a similar situation. So, here's a few more questions (please answer as many as you feel comfortable with):

1) What state are you in?
2) Attorney's name?
3) Any warning signs of lawsuit coming?
4) Good credit report (except for Discover of course)?
5) Any assets like a house showing on credit report?
6) Currently Employed? And, if so, does it show on CR? Do they know who your employer is?
7) Did they have a phone number and valid address for you?
8) How were you served?
9) Did you make any attempts prior to being sued to send payments to Discover?
10) Did you try to settle acct for less than 100%?
11) Did you send validation letter before being used?
12) Threaten Bankruptcy to OC/CA?
13) Did you consult an attorney?
14) What do you mean by "non-suited"?
15) In the event that they had shown up in court, how were you going to claim Discover in violation of FDCPA/FCRA? Was this just a bluff?

Sorry for all the questions, but like the name says, I'm just curious. I hope you win this thing. I've gotten a lot of good info off this board.
