I wrote this letter for a friend of mine in the past. This letter will work with you also. You may want to adjust some sentences in the letter for your own issues. Once the creditor has the letter via certified mail, they must cease all communications immediately other than what's federally prohibited. I'm going to replace the personal information with X's in this letter. Also, we'll call the collection Co. Jon Doe.

To Whom It May Concern:

You are being contacted regarding the above-reference matter. Mr. X has been informed JON DOE has attempted to contact him at his relative’s place of residence ( IN YOUR CASE, REPLACE THAT W/: PLACE OF EMPLOYMENT). JON DOE’s procedures and subsequent actions of this matter are in clear violation of the Fair Debt Collection Practices Act. JON DOE has violated the FDCPA by contacting third parties of Mr. X and leaving a messages with the third parties stating his name and the company he is calling from. Under no circumstances was JON DOE authorized to do so.

Please accept this notice, pursuant to the Fair Debt Collection Practices Act (FDCPA), that you cease all further telephone communications with Mr. X regarding the collection of this debt. All communication will be directed to Mr. X through written correspondence only (pursuant to 15 USC § 1692(c) (d); CC § 1788.11(d) (e)). This letter has been sent to JON DOE COLLECTION CO and to the Attorney General of California (this is the state my friend resided in @ that time) by certified mail. Upon delivery of this letter, all telephone communications will cease immediately.

Be advised that Mr. X is fully aware of his legal rights, your potential liabilities under law, and has the intent to pursue any and all available legal remedies against JON DOE COLLECTION CO should this letter fail to generate an appropriate response. Your failure to honor this request will constitute a violation of the FDCPA and result in further legal action against you.

When you or your employee writes this letter to the collection company, make for sure you use third person thoughout the entire letter. Instead of saying me or I, say MR. X. If your last name is Smith, then say Mr Smith thru the entire letter. Then at the bottom, type your full name after regards. Also, make for sure you send this letter to the collection agency via certified mail and pay the extra $2.00 for a return reciept. This will stop all calls. I hope this helps
