12/24/03 Hello ABC Collection Agency Inc. and James S. Mean Reference is made to your letter of 12/23/03 wherein it was stated; “This is an attempt to collect debt. Any information will be used for that purpose” As there are no funds lent, nor money borrowed, what is there to collect? How can an attorney, acting as a debt collector, collect something from nothing? Please read carefully the following from United States Code TITLE 18 PART 1 CHAPTER 63 Sec. 1341 – Frauds and swindles. Whoever, having devised or intending to devise any scheme or artifice to defraud, or for obtaining money or property by means of false or fraudulent pretenses, representations, or promises, or to sell, dispose of, loan, exchange, alter, give away, distribute, supply, or furnish or procure for unlawful use any counterfeit or spurious coin, obligation, security, or other article, or anything represented to be or intimated or held out to be such counterfeit or spurious article, for the purpose of executing such scheme or artifice or attempting so to do, places in any post office or authorized depository for mail matter, any matter or thing whatever to be sent or delivered by the Postal Service, or deposits or causes to be deposited any matter or thing whatever to be sent or delivered by any private or commercial interstate carrier, or takes or receives therefrom any such matter or thing, or knowingly causes to be delivered by mail or such carrier according to the direction thereon, or a the place at which it is directed to be delivered by the person to whom it is addressed, any such matter or thing, shall be fined under this title or imprisoned not more than five years, or both. If the violation affects a financial institution, such person shall be fined not more than $1,000,000 or imprisoned not more than 30 years, or both. Using the common carrier for illicit claims may be construed as violations of Federal and State Law. 1) Please have the enclosed Affidavit of Fact for Capitol One signed and notarized by your client and returned within thirty (30) days to the undersigned. Furthermore please find the enclosed Demand for Production of Original Note and take appropriate steps to produce it for my inspection unaltered and in its Original Condition and provide me with copies of all agreements signed by me and your client. I need clarification that the original loan is in fact legal and proof that your client has not acted outside of its corporate authority by lending credit, acting as a guarantor of credit, or acting as a surety thus creating an UltraVires Act. I further request from your corporation a copy of the sections of the FTC or state agency that gives statutory jurisdiction for a debt collector to act as an attorney and finally I will need a complete history of all monthly billing statements from the date the account was opened until the date of your letter 12/23/03. Regards, Marv Bear
