Hi, this is J Kelly and I just re-read my posts. I said I believe the debts will be sold to collectors in his own country. This post started with the subject of a foreign student leaving the country and not paying his debt. NOBODY is condoning that.
However, having a lot of international dealings for many many years, (not a foreign student and don't really know any) I am saying that international laws apply. No blanket answer to the question. Highly unlikely that the student in question will have a problem returning to the US because of bad debt. Homeland security is not interested in civil judgements. They are interested in much more serious things than that. Like trained pilots flying their planes into US landmarks.(six flts from Paris to the US cancelled today) Marsha is a Scandinavian citizen, visiting here for the holiday. She deals with consulates from many countries in her job. Homeland security is looking for weapons being taken on aircraft. They are protecting our ports and energy supplies. Yes, they are protecting our economy too, stock market crash, computer crashes. Debtors just aren't important enough for homeland security to be bothered with.
If someone takes that student to court, and he has committed fraud, then he will be detained IN THIS COUNTRY. That's the way it works. Who said this kid never had any intention of paying? I don't know him and I CAN'T READ HIS MIND AND NEITHER CAN YOU. As someone else mentioned if he has a payment history, then fraud will be very difficult to prove. We have laws and we have courts.
I feel very secure in saying again that he will not have a problem with international travel into the US or otherwise because of bad debt here. But, he might have to deal with collection efforts in his own country and they could be very harsh compared to the US where we are protected by Fair Debt Collection Law and bankrupcy law.
