I have accts with all three creditors you mentioned. Sears and Discover have recently charged off, and the Discover acct has been assigned to a CA. Right before Discover charged off, they sent me a final letter in which they said they would get a judgement. I have no idea why Discover likes to sue so much; I would've never gotten a card from them if I had known this. The Discover balance is large, but then again my credit report is horrible. This is one of the main reasons I asked about debt negotiations. I want a defense in court in case I'm used, e.g. "see, I am making reasonable attempts to settle my debts..."

My understanding is that if you get a summons, you should file BK immediately so that the judgement never happens.
