They are in violation of the FDCPA by leaving any message on your answering machine, other than their name and phone number. Answering machines and Faxes are not private communications. The FDCPA is based on the "least sophisticated consumer" and almost anyone would conclude the message was from a CA.

Keep the recording and if they do it again--file a complaint with the FTC and your AG.
