First, check the rules of civil procedure for the court you are being sued in. There may be a difference between small claim- county and circuit court- or whatever they call it in your state.

Once the time is up, it is probaby more like 20 days...you can file a motion with the court to compel discovery.

I don't believe failure to respond is grounds for a dismissal but it will keep them busy responding.

As for the jury trial, you are entitled to one if you want it. That motion might even move the whole case to another judge. You can tell you struck a nerve by their response.
