Unfortunately, its true, the divorce decree means squat when it comes to creditors. This is especially true in a community property state. If it was incurred during the marriage, the debt belongs to BOTH of you. Have you checked your credit reports for this debt ? That would give you some idea of the date of last activity. If the SOL has passed, you use that as your affirmative defense and its up to the Plaintiff to prove YOU wrong.
