You can be sued at any time.

If you have gone beyond the legal SOL, (4 years in Fl. on credit card accounts) you can DEFEND a lawsuit with the affirmative defense of the claim being time-barred.

If you notify a creditor, in advance, of the account being beyond SOL ( SOL letter from my website ) they have been put on notice legally that any lawsuit s time-barred.

If they STILL file suit, you can then countersue for damages as well as presenting a better defense.

The explanation as to WHY a signed credit card agreement is NOT a contract in writing has to do with the TERMS of the contract, not it's "physical written form".
