I'm surprised the IRS hasn't been after you for not filing the taxes to begin with ! If you do not file a return, the IRS basically does it FOR you and they do not use any of the exemptions that you might normally be able to claim. Therefore, the IRS's estimate of the tax you owe is a LOT higher than what it would be had you filed the proper returns. On top of that, they tack on years worth of interest and penalties !

You're going to have to file those returns. You CAN still do so. You'll have to call the IRS and order the forms for those years, you may even be able to download them from the IRS website.

To get your earnings information, call the employer(s) you were working for and tell them you need a duplicate W2 for those years. If they cannot provide them (but they SHOULD have those records !) you can always get a full accounting of your wages, including taxes paid, from the Social Security Administration. I had to go thru this with my S.O., so I know what CAN be done.

You have a lawyer, but I would strongly suggest you find yourself a taxpayer advocate, and quickly. They can help you get this straightened out.
