As long as your mom's responsibility was discharged under chapt 7 and the creditor was notified of the BK I would sit back and do nothing. Well maybe with the exception of sending the nice lawyer for the plaintiff a short letter saying that the debt was IIB and the creditor is already in deep doo doo and he will be too unless he immediatly files for a dismissal.

BA's actions in this matter are willful and egregrious violations of the BK code. From the case law I have been looking over recently I can tell that she is looking at a figure of around $5,000 in punitive damages in punitive damages alone. Maybe more.

Add in another $5000 for emotional distress and legal fees.

Go find your BK and tell him to take them to BK court for adversary proceedings.
