If you don't mind explaining your position to a judge and jury, there is nothing to be afraid of. The worse that will happen is that the court enforces the arbitration award and fees and court costs against you so you are no worse off than you are now.

You do need to know what the court rules and procedures are for the court you are in.

You can also do a request for production of documents and ask W&A to produce any files relating to you and your account.

You can take an oral deposition of the W&A or MBNA people involved but that cost money to do.

You can even subpoena records from MBNA to create some problems to W&A but again that costs money to do.

If the court thinks you may have a defense, the judge may try and force W&A to take a small settlement but that would be an unusual situation. But you never know until you try.
