You should get a free consultation with a BK attorney to go over your situation. You are only responsible for your individual and joint debts. You probably are not responsible for the debts that are in your husband's name alone.

You need to find out your state's inheiritance laws to see if you automatically got ownership of the entire house when your husband died because you may own it free and clear of any of his individual debts.

I believe a Chapter 7 BK allows you to keep up to $16,000 in equity in your home if you file individually and double that if you file BK as husband and wife. If you have more equity than that, Chapter 13 may be more appropriate and would allow you to keep your house if you qualify for it.

If you cannot file BK because of the equity in your home, you should consider selling the house if their are no judgments or liens against you yet and just take that money and run. Then file BK a couple of years from now to get rid of those debts.
