You should file an objection to their motion. State the facts. MBNA states interrogatories received on December 30, 2003. MBNA received interrogatories on December 8, 2003. Copy of return receipt for certified mail attached as proof. It is important to restate the facts in each pleading because the judge will not know what you are talking about otherwise. Remember, they look at the file when it comes to their desk for review or when you appear before to argue the motion. I would also file a motion to strike their objection. State that their objection has no basis in fact. Restate the facts as above and again attach a copy to the pleading. Bring the original to court with you in case you need it. You might want to go to the law library to get some direction with court approved forms.
