Delaware is tenants by the entirety state. I know your house is safe if you alone file bk. You indicate that this is your debt. I was in a similar situation and I filed bk. My car was ok, but I am not sure why. Worst case scenerio the car is only half yours and what would it be worth at sheriff's sale. File Chapter 7 NOW. If they get a judgement it is more difficult to get it vacated. I actually filed bk AFTER I was served. Immediately after. Make an appt. with a bk attorney. Good Luck.
