In new Hampshire we do not have online capability of checking for pending lawsuits. I Called the district court to see if i had been sued- as i dont trust these collection agencies to properly serve me- and if sued, i want to see a bankruptcy lawyer immediately- as well as empty my bank account- i figure ill have 30 days to answer the summons,(and declare BK) but i would still empty my bank account immediately, in case of a prejudgement seizure because Ive gotta pay the BK lawyer)Anyway, this clerk was quite nasty, but very knowledgeable! In NH every city has its own district court- you are sued in the town which you live, the ONLY address any creditor has is my mailbox(at a mailbox Ect. place) in another town- this is the town that i called(figuring that this is where ill be sued- even though they cant serve a Mailbox Ect) She was emphatic-"They MUST serve you a summons! Its the LAW!" I replied with the horror stories i have heard here. She insisted that i must be served with a summons. She asked me where i live, i told her. She says well you have to call THAT district court- i said "The creditors only have my address in your town" ... she laughed finally- she decided she would look in her system. She gave me some good info. The last time Providian sued anyone in that town was 2000! But my collection agency who bought the account last sued someone a year ago.. So i am going to keep calling, once a month, the two courts and make sure i havent been sued. I also check my credit reports- all three- every two months( and YES- I OPTED OUT) The only address on my credit report is my mailing address, and my employer from 3 jobs ago. I have no assets either.(other than my savings which will end up going to the BK lawyer anyway) Im doing the best i can to protect myself, and i have you guys to thank for this! If there are any things i am missing , let me know! The worst thing is when you have not been served properly and cannot protect the little you have left.
