Of course, if one is sued ( as Bob was) you are forced to deal with them in Court.

If an account is in arrears with the OC and you are trying to "negotiate" a settlement, it is sometimes difficult to know WHO you are actually dealing with. In the case of Providian, they had
most likely already sold off his account BEFORE he started "settlement" arrangements, of course, they would not have informed him of this.

If he had NOT been "paying" he likely would not have been sued, as the CA only looks for an easy win.

Even now, he can fight them in Court if he wanted to, based on deceptive trade practices, usury, constructive default (by Providian) bad faith, etc. etc.

The CA's are in business to make the most $$ they can with the least cost to themselves. They have a "rating" system that determines if they are going to sue or not, one of the criteria is an apparent "easy" willing to pay victim.

So, to answer your question, if you are within SOL, avoid ANY contact with the CA of any kind, no "validation" no "dispute" no "settlement" offers. If you pay one, you are in effect opening the floodgates to all of them.
