Hi,
I am in major credit card debt. The total debt was about $18,000 and now with interest and unable to make payments it is at $33,000. I have two toddlers and don't work. The credit cards are in my name only, my husband works, and pays the important bills (mortgage, secured loans, and utilities). I want to file bankruptcy as I have judgements and Discover card froze my bank account, and is threatening me. I don't have more than $2500 in personal assets, but our truck loan is in my name and we have about $4000 left to pay on it. It goes for $10,000 blue book value. I live in New York State. If I file chapter 7 on the credit cards only (if this can be done?) will they take our truck? This truck means a lot to us as it is our vehicle to get around in and I paid $17,000 cash down on it when my Mom passed away. I am filing in my name only and we want to continue with our mortgage, secured loans, and vehicles. I only want to get rid of the credit card debt. Can this happen without them taking everything? PLEASE HELP!
