I am not an attorney, but I believe you have to look in your particular state's statutes. Most have something regarding the timely filing of law suits. If the SOL has run then they are violating those state statutes regarding the timely filing of law suits. They are time barred. To violate that then is to file a frivolous law suit, you have grounds for defamation of character, and damages including your attorney fees, court costs etc. I believe it is also a violation of FDCPA, to file a time barred law suit.
If you are serious about it, hire a good attorney who is willing to follow through, to collect his legal fees, as part of the damages.
Good Luck
Rlee
