You can countersue because the CA, considered by the court to be an expert in his field, sued you knowing the suit was time-barred. In other words, because the debt was SOL the suit should not have been filed. This is seen as nuisance litigation, costing the court time and money for an action which will be squashed by your absolute defense - the suit is time-barred because the debt is SOL. Thus the suit would be dismissed on SOL grounds and the CA stooge knew this before he filed. Remember, CA's can perhaps send you a letter trying to collect SOL debt, but filing suit is another story.
He's cost you money to defend yourself, he's defamed you, in all probability he won't have any evidence to prove his claim.
CA piggy-doots try to convince debtors that rules don't exist, they can file suit and next thing you know some hulking beer-bloated berserker in a sheriff's get-up is ripping out your eye-teeth to satisfy a debt. Pliers flailing, horrid screaming, blood and tissue flung about the room. Hideous. This is the picture our beloved Judge Crazy Man paints for debtors when he holds Small Shams Court arraignment sessions, romping about his courtroom like a demented orangutang. Gout-riddled gabardine clad smelly nancy-men bankers and four hundred pound dungeon-social ladies sit offside during this solo act, their eyes gleaming with avarice in anticipation of being turned loose upon debtors. You see, these are the 'Mediators', provided as a 'free service' to we little people by our kindly zoo keepers. Right. Treat them all as the enemy. They are out to coerce money from you, then toss your quivering carcass into the courthouse dumpster. Three-time death row losers are treated with more kindness and dignity.
The laws and protections are in your favor. As one knowledgeable attorney expressed it, "CA's wade into a thicket of trouble when they collect, especially when they file suit." In other words, start filing complaints with the FTC and your state AG. Tell them everything these punks screamed at you, send copies of all their poxy letters. Let the agencies tally the violations.
These bullies count on debtors' unawareness of their rights and protections under the law and natural fear of court action. Knowledge is power. We are here to assist you on your pathway to victory over these grasping three-clawed swine otherwise known as 'collections professionals.
