Lady is correct. This is standard operating procedure. I have seen the same tactic used in court after the plaintiff presented a mountain of evidence that the case should be ended because there was no proof of the claim. Almost always denied. You need to file an objection to the motion for summary judgment. First, file a request with the judge/court to file an amended answer. What are you defenses? Sol? What state?
