It all depends on several things.

First you need to check the local courthouse and find out if the collection agencies are prone to sue in your state. Second you need to find out if they are licensed in your state to sue. Third you need to list your assets, look at what is exempt by state law by going to the bankruptcy site that lists the exemptions. (http://www.thebankruptcysite.com/what_do_i_keep.htm) and then find out the statute of limitations (www.creditinfocenter.com) for your state to find out if you are sueable. Creditors will rate you to see if you are worth suing or not.
