Bartmann and CFS Still Active in Courts

January 16, 2004 — Bill Bartmann’s trial may have ended recently with an acquittal, but that can’t stop the avalanche of legal proceedings in the wake of Commercial Financial Services’ spectacular collapse five years ago.

Late last week, James Sill, the former president of Dimat, Inc., the sham corporation that bought credit card accounts from CFS, was sentenced to six-month in prison for tax evasion. This despite the request of both the prosecution and the defense for Sill to receive probation for the crime he pleaded guilty to in March of last year.

In handing down the verdict, U.S. District Judge Joe Heaton stated that Sill’s case was "not an isolated incident of someone cheating on his taxes." Heaton instead framed Sill’s case against the larger backdrop of the CFS collapse and the legal fall-out that accompanied it.

Sill did testify in CFS’s former CEO Bill Bartmann’s trial in October. He helped to corroborate a key point for the prosecution that Bartmann knew about the activities of Dimat.

According to reports, when Bartmann was informed of Sill’s sentence last week, he replied, "It sounds like justice has been served."

But Bartmann himself returned to courts this week. Appearing with his wife on Wednesday, they were seeking delay collection activities of a trustee, pending an appeal of a bankruptcy judge's ruling.

Reportedly, a judge will consider the request.
