This is an affirmative defense by the way. They breached their contract with you. You in good faith contacted them, explained your new circumstances and asked for an extension and relief plan which is perfectly ok to do. There was an offer and an agreement in writing to this plan...in essense, a new contract. They reneged and broke the contract. You have grounds for an affirmative defense if you have to. Keep all your paperwork. You may still be obligated for the balance of the account, but with an affirmative defense like this I would imagine that you could dispute any collection costs and attorney fees that Discover tries to add to your account. You were acting in good faith. Make at least six copies of your paperwork and keep them in separate folders. Get a nice one just in case you have to go to court.
