This issue is addressed in each State's Usury laws, the ONLY State I am aware of that has STRICT enforcement of it's usury laws in the case of 3rd party collection agencies is Tx.

NY has some additional protection against usury in some of it's statutes. I usually advise people to include usury as a defense in Court when they are being sued by a CA, however, to find caselaw on the subject would, of neccessity have to be on a State by State basis, and would likely NOT be found in consumer law cases.
