Hi all-

This is happening in PA. This entire thing seems very fishy.

Despite the fact that I have very little money I will be discussing this with legal aid (If I dont make too much...Im stuck in the working poor class).I will also be sending complaints to BBB and the Attorney General.

Here is the deal (names witheld for obvious reasons) :

I was sued for nonpayment of a charge card a year ago. I fully believe that the SOL has run if I can find out when my first delinquency was that I didnt catch up (as per WhyChat).

I answered the complaint with an affirmative defense of SOL and denied everything else because of lack of information. They never once was sent anything to prove that I owe this money even after my lawyer (at the time) and I repeatedly asked.

I won a default judgement because they never showed for the court date. They appealed. Never heard a thing from them about an appeal.

Fast forward to summer. I recieved letters for a settlement. I figured this was quite humorous since I had won the lawsuit.

Fast forward again to present day. I recieved a letter that they are seeking a reversal of the judgement upon admissions (I finally looked up what they are) that I never recieved. Needless to say I am very mad and feel they are screwing me.

I never responded because I never got anything that even resembled "Admissions". I would have denied most of them also. They need to come to court and prove that I owe this.

A court date to hear this motion is set for near future. I will be filing anything and everything I can.

I WANT MY DAY IN COURT.

I want these scumbags to prove I owe the money and that SOL hasnt run its course.

Any advice??

Im willing to file bankruptcy if I have to (Yes I know the ramifications).

Maybe a CRRR validation letter. Ive heard they can stop a lawsuit if not answered properly.

Thanks in advance
