Sorry all, my 17 year old is having surgery Friday and I had to take him for his anethesiologist consult. I think my first post was Dec 13. It pretty much tells the basics.

I found posts from Nov 30 & Dec 1 from survivor, Drew & beenitdoneit that involve citibank and the same attorney that I'm dealing with.

I'll try to clarify...it is a CC debt, last payment Jan '03, we're in NC. I got a letter from RMA June 9, 03 saying that the "acct has been placed with this company for collection. Please remit the balance to Risk Management Alternatives, Inc." It states that the creditor is Citibank.

Than I received another letter from RMA July 16, 03 saying "At this time we are authorized by Citibank to make a generous settlement offer to you. You actually owe: $5686 Settlement amount: $3980 Amount must be received by 7-27-03. In order to take advantage of this offer, send you check or money order, made payable to RMA no later that the date shown immediately above."

The summons & complaint were served Dec 10, 03 from Bernhardt & Strawser, PA in Charlotte, Plaintiff: Citibank South Dakota, NA. Attached to it was a notarized affidavit from an Attorney Management Specialist in Missouri, employed by contract, CCSI/USA. By virtue of employment all information contained in and /or about delinquent Universal Bank, NA CC accts are made available to me for the purpose of collecting such delinquent debt." It goes on to say she has personal knowledge of all relevant financial & acct info, name, address of debtor, history of all charges representing loadns, finance charges, fees, pymts, etc.

It also says "Demand for pymt was made more than thirty days prior to making this affidavit, after which the attorneys representing Citibank were retained for the purpose of collect the delinquent debt owed"..."Exhibit A is a hard copy print out of the financial info including the balance owing, residing on the Citibank computer systemas of the date the acct was referred for collectio to the attorney maintaining this lawsuit." Then there is a copy of a statement Aug 7 - Sept 8.

I haven't filed anything more since I filed the Notice of Appearance and my Answer, which was wrong because I didn't list any defenses (post Jan 14) At that point I felt like I was only making the situation worse trying to handle it myself. Bud Hibbs e-mailed me and told me to search for a consumer attorney through NACA, which I did. I found (1) listed in this area. I played phone tag with him last week and finally e-mailed him on Sunday...he e-mailed me back and said because of the sheer number of cases he had been required to limit his practice area. He said that I need to retain a lawyer if I want to proceed with the matter. I thanked him & asked if he could recommend any attorneys in this area. He e-mailed me 3 names; 1 BK and 2 who handle BK as well as non-BK litigation.

That's where things stand now. My "superwoman" cape is sadly tattered between trying to keep the attorney in WV after the judge to enforce his orders, trying to find another job, going to class, getting my son ready for his surgery, trying to figure out what is the "best" thing to do with this mess to name a few....maybe I should start making lemonaid with all of these lemons that seem to be coming at once. Isn't that how it usually happens though? I think if I could simple sleep for about 8 or 10 hours I would feel better!

So sorry this is so long, bet nobody asks me to fill in some of the facts for you again. Sorry Rlee.
