Do not let them get a consent judgment. WhyChat will explain why? You may want to countersue them for abuse of process since you have been making payments on it and you don't feel that you should be sued. Especially if the payments are reasonable. Do a general denial of their claims and file your own defenses. They sued. Let them bring the sandwiches and stop talking to them. If you are making payments and they sue, it is time to stop talking to them. They want something. DOes your husband have a savings account or stock options they can get their hands on. Texas is a community property state and creditors can sometimes go after the property of the spouse if the debt and the card was taken out during your marriage.

This is where you want your day in court. Start taping them when they call and if you or your husband has assets, get an attorney to protect them.

www.naca.net has a list of consumer attorneys that can help you.

Good luck.
