Who's fault?

I just received my credit report after I was supprised I had been declined for credit. It turns out that Experian shows a bankruptcy, and all the charge off's from the bankruptcy on my report. I know that these are my fathers debts and chapter 7. I am named after him but we have different middle names. Is this the reporting agency's fault, or is it on public record for me? Also, will it just show up again on my report after I clear it up? I'd appreciate any advice or comments.
