As ive posted before, i am now calling the courts to check for any lawsuits being brought against me from the two collection agencies handling my large Providian accounts- SOL is 3 years and i have 1.5 years to go. Havent even received a letter from these places. I am still perplexed by the idea of NOT being served as i hear the horror stories about default judgements and not being served..
These district courts in NH (i am checking with two towns where i could be served)INSIST that i MUST be served by a sheriff- anything above small claims(over 5000) MUST BE SERVED By a sheriff- no exceptions.
As ive said before, i plan on filing bankruptcy immediately if sued. I WILL NOT let these CA's levy my bank accounts.
Someone posted that a sherriff can STAPLE a SUMMONS to your door? Is this true? As you all know these companies only have my mailbox Ect address, my credit report only has this address, and my drivers liscense has my address from 3 years ago- a town 50 miles away. In NH you must be sued in the town where you LIVE in that towns court..
If these jerks do not get my physical address- which i believe they will not- how can they serve a mailbox ect in another town?? How would this work? The courts said a certified letter IS NOT legal. Any experiences with this? Its not being sued that worries me, its NOT KNOWING immediately, and being given that 4 precious weeks to take action.
