Who has the account, the credit card company inhouse collection team or an outside collection agency. I know it is illegal for a collection agency to call a cell phone because they can't cost the debtor money in their attempts to collect. However I am not sure that this applies to original creditors.

If it is the original creditor, there are no laws governing what the original creditor can do on the federal level. Your state laws may offer a little protection there but the original creditors can do what they want and they do. A cease and desist letter won't work with them, they don't have to validate, and they don't have to accept any payment plans you offer.
